1. Acceptance of Terms
These Terms and Conditions ("Terms") govern your access to and use of the website located at faithscreener.com, the FaithScreener web application, related APIs, and any related services (collectively, the "Service") operated by FaithScreener ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service.
If you are entering into these Terms on behalf of a company, organization, or other legal entity, you represent that you have the authority to bind that entity to these Terms, in which case "you" refers to that entity.
2. Description of the Service
FaithScreener is a stock screening and research tool. The Service computes compliance verdicts for publicly traded equities against published faith-based investing frameworks, including the AAOIFI Standard 21, the Dow Jones Islamic Market methodology, the S&P Shariah methodology, the FTSE Yasaar methodology, the MSCI Islamic methodology, the Christian Biblically Responsible Investing screens, the United States Conference of Catholic Bishops 2021 Socially Responsible Investment Guidelines, the Halakhic Investing framework, and the Word of Wisdom (Doctrine and Covenants Section 89).
The Service does not constitute investment advice, financial advice, legal advice, religious advice, brokerage services, or asset management services. The Service does not execute trades, hold customer assets, or provide personalized recommendations. We do not act as a broker, dealer, investment adviser, or registered representative under any securities or investment law.
3. Eligibility
You must be at least 18 years of age and capable of forming a binding contract with us to use the Service. By using the Service, you represent and warrant that you meet these eligibility requirements. You also represent that you are not located in a jurisdiction where use of the Service is prohibited by applicable law, sanctions, or regulation.
4. Accounts
Some features of the Service require you to create an account. When you create an account, you agree to provide accurate, current, and complete information, and to keep your account information up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
You agree to notify us immediately at [email protected] of any unauthorized use of your account or any other breach of security. We are not liable for any loss or damage arising from your failure to comply with this section.
5. Subscription Plans, Pricing, and Billing
The Service offers a free tier and a paid Pro tier. Pro tier subscriptions are available on a monthly or annual basis at the prices stated on the Service's pricing page at the time of purchase. Pricing is subject to change, but changes will not affect existing subscriptions until the next renewal date.
Payments are processed by Stripe, Inc. By providing payment information, you authorize us to charge your selected payment method for all fees incurred. Subscriptions automatically renew at the end of each billing cycle unless cancelled prior to the renewal date.
You may cancel your Pro subscription at any time from your account settings. Upon cancellation, you will retain access to Pro features until the end of your current billing period. We do not provide refunds for partial billing periods, except as required by applicable law.
We reserve the right to change prices, features, or limits of any subscription tier at any time. Material changes to existing paid subscriptions will be communicated to affected users by email at least 30 days in advance of the change.
6. Acceptable Use
You agree not to use the Service for any unlawful purpose or in any way that could harm the Service, other users, or any third party. Without limiting the foregoing, you agree not to:
- Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Service
- Scrape, crawl, or harvest content from the Service except through our published API and within published rate limits
- Resell, sublicense, lease, or commercially redistribute access to the Service without our prior written consent
- Use the Service to build or train any competing product or machine learning model
- Circumvent any rate limits, paywalls, or access controls
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity
- Upload or transmit any malicious code, viruses, or harmful data
- Interfere with or disrupt the operation of the Service or the servers and networks used to provide the Service
- Use the Service in connection with money laundering, sanctioned activities, terrorism financing, or other unlawful purposes
7. Intellectual Property
The Service, including all software, text, graphics, logos, images, methodologies, compilations of data, and other content, is owned by FaithScreener or its licensors and is protected by copyright, trademark, and other intellectual property laws. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal or internal business purposes.
The compliance methodologies referenced by the Service (AAOIFI, Dow Jones Islamic, S&P Shariah, FTSE Yasaar, MSCI Islamic, BRI, USCCB, Halakhic, and Word of Wisdom) are the property of their respective owners. FaithScreener is not affiliated with, endorsed by, or sponsored by any of these organizations.
8. Data Sources and Accuracy
The Service derives financial data from publicly available sources, including but not limited to filings made with the United States Securities and Exchange Commission (EDGAR), exchange disclosures, and third-party data providers. We make no representation or warranty as to the accuracy, completeness, timeliness, or reliability of any data displayed by the Service.
Compliance verdicts are computed mechanically by applying published framework rules to the most recent available financial data. Verdicts may change as new data is filed. A compliant verdict on one date does not guarantee continued compliance on a subsequent date. You are responsible for verifying any information presented by the Service before making any investment decision.
9. No Investment Advice
The Service is provided for informational and research purposes only. Nothing displayed by the Service constitutes investment advice, financial advice, tax advice, religious advice, or a recommendation to buy, sell, or hold any security. You should consult with a qualified financial professional and a qualified religious authority before making any investment decision.
Past performance is not indicative of future results. The value of investments can go down as well as up, and you may not get back the amount originally invested. We are not responsible for any losses, financial or otherwise, that you may incur as a result of using the Service.
10. Disclaimers
The service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy. We do not warrant that the service will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
FaithScreener is not affiliated with any Shariah supervisory board, Christian denomination, Catholic diocese, Jewish rabbinic authority, or LDS church entity. References to these organizations and their published frameworks are for descriptive purposes only.
11. Limitation of Liability
To the maximum extent permitted by applicable law, in no event will FaithScreener, its affiliates, officers, directors, employees, agents, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation lost profits, loss of data, loss of goodwill, or any other intangible losses, arising out of or in connection with your access to or use of the Service.
Our total cumulative liability to you for any and all claims arising out of or relating to the service shall not exceed the greater of one hundred united states dollars or the total amount you have paid to faithscreener in the twelve months preceding the event giving rise to the claim.
12. Indemnification
You agree to indemnify, defend, and hold harmless FaithScreener and its affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any rights of another party.
13. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including if we believe you have violated these Terms. You may terminate your account at any time by contacting [email protected] or by using the account deletion option in your account settings.
Upon termination, your right to use the Service will immediately cease. Sections of these Terms that by their nature should survive termination shall survive, including without limitation provisions on intellectual property, disclaimers, limitation of liability, indemnification, and governing law.
14. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts.
You and FaithScreener agree that any cause of action arising out of or related to the Service must commence within one year after the cause of action accrues. Otherwise, such cause of action is permanently barred.
15. Changes to These Terms
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or by posting a notice on the Service prior to the changes taking effect. Your continued use of the Service after such notification constitutes your acceptance of the modified Terms.
16. Miscellaneous
These Terms constitute the entire agreement between you and FaithScreener regarding the Service and supersede all prior agreements and understandings. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.
You may not assign these Terms or any of your rights or obligations hereunder without our prior written consent. We may assign these Terms freely.
